Billing Terms

A. General

1. Defeat Diabetes Pty Ltd offers subscription-based access to the Defeat Diabetes Low Carb Program App (“Foundation Plan”), an HbA1c referral service through our provider Bloody Good Test (“Progress Plan”) and telehealth for dietetics and health coaching via our provider Low Carb Keto Health (“Support Plan”). All three services (the Defeat Diabetes Low Carb Program, the HbA1c referral service and the telehealth service)  are included in our “Complete Plan”.

2. Our Terms and Conditions govern all purchases.

3. Subscriptions may be purchased through:

1. The Defeat Diabetes website (Website Purchase) or

2. External platforms (In-App Purchase).

4. Subscription plans may vary based on your location or where the purchase is made.

5. The subscription fee applies regardless of the frequency or amount of use.

B. In-App Purchases

1. These refer to purchases made via external platforms like the Apple App Store, Google Play or other similar stores.

2. The respective App Store, not us, handles the billing for In-App Purchases.

C. You agree that:

1. In-App Purchases are governed by the terms, conditions and licensing agreements of the respective App Store.

2. Payments are processed securely through the App Store's payment gateway.

3. For payment-related issues or refund requests related to In-App Purchases, you must contact the relevant App Store.

D. Website Purchases

1. Subscriptions, products and services bought via the Defeat Diabetes website are managed and billed by us.

2. Website purchases are processed securely through a third-party payment provider, Stripe, with their terms and conditions applied.

3. Transactions are SSL encrypted and PCI-compliant. We do not store credit card details.

E. Payment

1. Payment is required at the time of purchase unless a free trial applies.

2. Subscriptions automatically renew on the first day of the next billing cycle.

3. You must inform us of any payment method changes.

   3.1. We assume your payment details are correct and will continue charging fees accordingly.

   3.2. If a payment fails, your subscription may be suspended until full payment.

   3.3. We reserve the right to adjust subscription fees with 14 days' notice for future billing cycles.

   3.4. If you don’t cancel your subscription within 14 days of a fee change notice, it will be deemed accepted.

F. Free Trials

1. New users may be eligible for a limited-time free trial as specified during sign-up.

2. Free trials are only available once per user at our discretion. Signing up for additional trials may result in an immediate charge.

3. We reserve the right to cancel a free trial at any time.

4. If not cancelled before the trial ends, the subscription automatically converts to a paid one.

G. Promotions

1. We may offer promotions, discounts, or coupons from time to time. These may be subject to separate terms and conditions.

2. Promotional subscriptions will automatically renew unless cancelled at the end of the offer period.

H. Cancellation

1. You can cancel your subscription at any time.

2. Cancellations must be made at least 24 hours in advance to avoid charges for the next billing cycle.

3. After cancelling, access to the service continues until the end of the current billing period.

4. To cancel, use your Defeat Diabetes member profile for web purchases and iTunes or Google Play for in-app purchases.

5. If your subscription was an In-App Purchase, you must disable auto-renewal or cancel via your device or the App Store.

6. You will be responsible for any related costs if we need to collect unpaid fees.

7. We do not provide refunds or credits for unused subscriptions, accidental purchases, or similar circumstances unless required by law.

I. Governing Law

The laws of New South Wales, Australia govern these terms. 

J. Interpretation

1. "Billing Terms" refers to these terms, including any future amendments.

2. "Payment Method" refers to the account or process used to pay for products.

3. "Products" include goods, services, and digital content offered by us.

4. "Terms and Conditions" include our Privacy Policy, Returns Policy, and Disclaimers, available on our website.

5. "We", "Our", and "Us" refer to Defeat Diabetes Pty Ltd.

6. "You" and "Your" refer to the customer or subscriber.
